Concept

• Patent/utility solution assignment refers to the transfer of ownership of a patent or utility solution by the owner of industrial property rights to another organization or individual.
• Such assignment must be effected by a written agreement.

Required Documents

• Declaration in accordance with Form No. 06, Appendix II of Circular No. 10/2026/TT-BKHCN;
• Assignment agreement for a patent/utility solution in compliance with Article 140 of the Law on Intellectual Property (as amended and supplemented in 2009, 2019, 2022, and 2025);
• Power of Attorney (if filed through an industrial property representative);
• Original Patent/Utility Solution Certificate (for endorsement of the new owner’s details);

Procedure

• Filing the application at the headquarters of the Intellectual Property Office of Vietnam (IP Vietnam) in Hanoi, or at its representative offices in Da Nang and Ho Chi Minh City;
• Examination period: approximately 02–04 months from the filing date;
• Decision on recordal of the assignment of the Patent/Utility Solution:
  • If valid: IP Vietnam issues a decision to record the assignment and publishes the same in the Industrial Property Gazette;
  • If invalid: IP Vietnam issues a notice of intended refusal, granting a period of 01 month for remedying deficiencies or submitting arguments in response;

Important Notes

• Any changes relating to the owner’s information should be recorded promptly to ensure the continued legal validity of the title;
• Where maintenance of the patent/utility solution and amendment of owner information are intended simultaneously, such procedures may be combined into a single application to save time and costs;
• Where multiple titles are assigned concurrently, a single consolidated dossier may be filed for all such titles;
