Concept

• Trademark application assignment refers to the transfer of rights in a trademark application, whereby the applicant requests a change of the applicant to another organization or individual
• Such assignment must be effected by a written agreement on the transfer of the application.

Required Documents

• Declaration in accordance with Form No. 11, Appendix I of Circular No. 10/2026/TT-BKHCN;
• Written agreement on the assignment of the trademark application;
• Power of Attorney (if filed through an industrial property representative);

Procedure

• Filing the application at the headquarters of the Intellectual Property Office of Vietnam (IP Vietnam) in Hanoi, or at its representative offices in Da Nang and Ho Chi Minh City;
• Examination timeline: prior to the grant of the protection title;
• Notice on recordal of change of applicant:

• If valid: IP Vietnam issues a notice recording the change of applicant and publishes the same in the Industrial Property Gazette;
• If invalid: IP Vietnam issues a notice of intended refusal, granting a period of 01 month for remedying deficiencies or submitting arguments in response;

Important Notes

• Any changes relating to the applicant’s information should be recorded promptly to ensure the continuity and legal validity of the application;
• Where amendment of applicant information is intended concurrently with other procedures, such changes may be combined into a single application to save time and costs;
• Where multiple applications are assigned concurrently, a single consolidated dossier may be filed for all such applications;
