An investment project is a proposal to invest medium or long-term capital to carry out business investment activities within a specified period of time and place. In particular, the expansion investment project aims to improve the scale, capacity, technology and reduce pollution and improve the environment.
A common question is whether foreign companies enjoy incentives when expanding investment projects. According to the provisions of law, expansion investment projects are still entitled to incentives if they meet a number of conditions on investment lines and areas. Investment incentives include lower tax rates, import tax exemptions, land use levy exemptions and other forms of incentives in accordance with the corporate income tax law and relevant regulations.
The expansion of the investment project leads to the requirement to adjust the investment certificate. An adjustment dossier comprises:
1. A written request for adjustment of the investment project.
2. Report on the implementation of the project up to the time of adjustment.
3. The investor's decision on the adjustment of the project (for organizations).
4. Explanations or documents related to the adjusted contents as prescribed by the Law on Investment.
The investor submits the dossier to the competent authority in two forms:
1. Submit directly to the competent investment registration agency.
2. Online declaration of information at the National Information System on Foreign Investment (dautunuocngoai.gov.vn or fdi.gov.vn). Within 15 working days from the date of declaration, the investor must submit 03 sets of dossiers for adjustment of the investment project certificate.
- Management Boards of industrial parks, export processing zones, hi-tech parks and economic zones: receive and adjust investment registration certificates for projects in their management areas.
- The Department of Planning and Investment: to receive and adjust investment registration certificates for projects outside industrial parks, export processing zones, hi-tech parks and economic zones.
Within 15 working days from the receipt of a complete dossier, the Investment Registration Authority will process and issue a decision to adjust the Investment Certificate.
