A work permit is a document issued by the Ministry of Labor, Invalids and Social Affairs or the Department of Labor, Invalids and Social Affairs that allows foreigners to work temporarily in Vietnam. The maximum duration of a work permit is 2 years. When the permit is nearing expiration, the employer must initiate the renewal process so that the employee can continue to work legally in Vietnam.
To renew a work permit, the organization or business employing foreign workers must meet the following conditions:
1. The work permit must be valid for 5 to 45 days.
2. There must be an official document approving the need for foreign labor from the competent authority.
3. Documentation must prove that the foreign worker will continue to work at the organization or business as stated in the work permit.

The work permit renewal process consists of two main steps:
Step 1: Request for Approval of Labor Needs
- Documents to prepare:
- Form 02/PLI - Report explaining changes in the need for foreign labor.
- A certified copy of the business registration certificate of the enterprise.
- Where to submit the application: Ministry of Labor, Invalids and Social Affairs or the provincial People's Committee.
- Submission timeline: At least 30 days before the work permit expires.
Processing time: Within 10 working days from the date of receipt of the application, the competent authority will issue an approval or disapproval for the use of foreign labor.
Step 2: Renewing the Work Permit
- Documents to prepare:
- The original work permit.
- Form 11/PLI - Application for work permit renewal.
- Two photos (4x6 cm) with a white background, taken within the last 6 months.
- The original document approving the need for foreign labor.
- A notarized copy of the foreign worker's passport.
- A health check certificate valid within 12 months.
- Documentation proving that the foreign worker will continue to work in Vietnam (contract, agreement, or document assigning the worker to Vietnam).
- Note: Documents from foreign organizations or agencies must be translated into Vietnamese and legalized.
- Receiving authority: Employment Department under the provincial Department of Labor, Invalids and Social Affairs or the Ministry of Labor, Invalids and Social Affairs.
Submission timeline: At least 5 days but no more than 45 days before the work permit expires.
- Processing time: Within 5 working days from the date of receipt of a valid application. If the renewal is denied, the competent authority will provide a written response stating the reasons.

Work permits can only be extended once, with a maximum duration of 2 years. The extension period depends on the following factors:
1. The duration specified in the approval document for employing foreign workers.
2. The duration of the employment contract to be signed.
3. The duration of the agreement or contract between the foreign partner and Vietnam.
4. The duration for which the foreign organization sends workers to Vietnam.
5. The duration of the service provision agreement or contract between the foreign partner and Vietnam.
6. The duration specified in the operational license of the organization or enterprise.
The duration stated in the document from the service provider sending foreign workers to Vietnam for establishing a commercial presence or negotiating service provision.
7. The duration noted in the document proving that the foreign worker is employed at a foreign enterprise that has established a branch or representative office in Vietnam.
